School Rules

CHMS Discipline Plan


I.          BELIEF Statement

We believe that all students can and will learn in a safe and orderly environment. We feel that all students have a responsibility to behave in a manner that will not prevent teachers from teaching and students from learning. No one has the right to violate the best interest of any individual in the school community. Behavior guidelines will be consistently and fairly enforced inside and outside the school classroom. Our school Discipline Plan applies to all school activities on and off campus including field trips, dances, and performances.

All pupils shall comply with the regulations, pursue the required course of study, and submit to the authority of the teachers of the schools. California Education Code §48908.


Every pupil shall attend school punctually and regularly; conform to the regulations of the school; obey promptly all the directions of his teacher and others in authority; observe good order and propriety of deportment; be diligent in study; respectful to his teacher and others in authority; kind and courteous to classmates; and refrain from the use of profane and vulgar language.

California Code of Regulations, Title 5, Section 300


II.         Basic School Rules          

                        Calavera Hills Middle School has 4 School Rules to which all other posted rules apply.

They are:





                        Remember to be SURE at all times!!!


1)         Follow the directions of all staff members the first time.

2)         Respect the rights and property of others.

3)         Be in your assigned classroom with the appropriate materials when the bell rings.

4)         Maintain a safe and productive learning environment.

•     The following items are not permitted at school at any time: gum, sharpie/permanent markers, balloons, rubber-bands, whiteout pens, audio and visual recording devices, golf balls, toys, and noise makers (includes whistles).

•     Skateboards, rollerblades, roller skates, toy vehicles, scooters or any other similar forms of transportation are not allowed. California law requires that students wear helmets when riding a bicycle.

•     Cellular phones and other signaling devices must be out of view and turned OFF during school hours. These items will be confiscated if the rules are violated and only returned to the student’s parent/guardian. A student phone is provided in the main office for use before school, and/or after 3:00 p.m. (2:00 p.m. on Thursdays). Regulated by California Education Code §48901.5.

•     Keep walkways clear at all times, including stairways. Please walk on the right to promote safe traffic flow.

•     Students not involved in school-sponsored activities must be off campus by 3:00 p.m. (2:00 p.m. on Thursday’s).

•     Calavera Hills Middle School is not responsible for lost or stolen items.
Students are under the jurisdiction of the school district during any of the following:

(1) While on school grounds.

(2) While going to or coming from school.

(3) During the lunch period whether on or off the campus.

(4) During, or while going to or coming from, a school sponsored activity.


III.        Bullying/ Intimidation

The Carlsbad Unified School District will not tolerate behavior that infringes on the safety of any student. A student shall not intimidate or harass another student through words or actions. Such behaviors include: direct physical contact, such as hitting or shoving; verbal assaults, such as teasing or name-calling; and social isolation or manipulation.


Bullying is defined as exposing a person to negative, abusive actions repeatedly over time. Bullying can be direct or indirect and includes specific types of physical, verbal, and/or psychological aggression and intimidation that occurs repeatedly creating an on-going pattern of harassment and abuse (this includes “cyber bullying” or “text-messaging”).






  • 0-1 tardies; no truancies
  • Makes the class better because of his/her presence.
  • Consistently shows respect for others, their ideas and their property.
  • Shows good thinking and positive behavior by daily participation.
  • Prepared with required materials and reading books daily
  • Stays on-task during work periods.
  • Talks at appropriate times; is not disruptive.
  • Cooperates well in groups
  • Solves problems independently



  • Rarely tardy – no truancies.
  • Rarely, if ever, violates school rules.
  • Regularly on-task in classroom situations, with few exceptions.
  • Participates well in class with politeness.
  • Is cooperative and shows respect for others and their property.
  • Is regularly prepared and usually has necessary supplies.
  • Displays signs of self-discipline.



  • Occasional tardies – no truancies.
  • Off-task behavior observed on a regular basis.
  • Occasionally shows negative or judgmental attitude towards other students.
  • Behavior, punctuality, effort and dress issues are inconsistent.
  • Forgets necessary supplies.
  • Occasionally talks out of turn.
  • Does not follow directions given the first time.
  • Lacks self-discipline; unable to solve problems independently.



  • Frequently tardy – one or more truancies.
  • Rarely prepared for class.
  • Is rude, belligerent or uncooperative with peers and/or staff.
  • Often hinders the progress of the class.


V.      Dress code and Grooming Policy

The faculty believes that appropriate dress and grooming contribute to a productive learning environment. Students are expected to attend school in clean, neat clothing. Distractions to the educational environment are not beneficial to student learning. Students in violation of the dress code policy are subject to disciplinary action.

       School dress code applies to all school activities, including field trips and dances.


Please respect the dress code.

       Clothing must be neat, clean, and fit properly.

       Clothing and accessories cannot advertise promote, or glamorize any of the following: drugs, alcohol, tobacco products, violence, weapons, or display inappropriate or sexually suggestive language or symbols.

       Clothing that is revealing, such as tops that are strapless, see-through, low-cut, or expose the midriff are not permitted. Pajamas and slippers are not permitted. Undergarments must not be visible at any time.

       Tops must cover undergarments, chest, back, and midriff areas. Shoulder straps of 2 inches or more wide (3 fingers width) are acceptable (No spaghetti straps are allowed).

       Pants must stay up to your waist. "SAGGING" IS NOT ALLOWED.

       Shorts and skirts must be longer than fingertips when arms are relaxed at sides.

       Footwear must adequately protect feet and not interfere with required school activities. Shoes must ADHERE to the foot; therefore, they must have a back covering. Flip flops are not permitted (unless directed by a doctor’s excuse).

       Students may not wear clothing that denotes gang affiliation as defined by Carlsbad Police task force.

       Wallet chains are not allowed at school. Accessories may not have metal studs or spikes.

       Jewelry, wallet, and accessories that, in the opinion of the staff, attract undue attention or could pose a threat to the safety of others are not permitted.

       Hats and hoods may NOT be worn indoors. Bills of hats must be worn facing forward. 


       Bandanas are not permitted at any time.

       Sunglasses are not permitted indoors, unless with prescription or doctor’s note.

       No rollerblades or shoes with wheels allowed.

       In an effort to maintain the belief that education is our primary purpose, the staff will address new fads that occur during the school year such as extreme hairstyles, etc.

       The Administration always reserves the right to determine what is appropriate or inappropriate.

  Consequences for dress code violations:

                                      1st offense:      Warning, *Change Clothes (or address the violation by wearing over shirt, sweater, etc.)

                                      2nd offense:     Warning, *Change Clothes (or address the violation by wearing over shirt, sweater, etc.), Parent Telephone Call, Brunch/Lunch Detention Assigned

3rd offense:      *Change Clothes (or address the violation by wearing over shirt, sweater, etc.), Parent Telephone Call, After School Detention assigned

4th offense:       *Change Clothes (or address the violation by wearing over shirt, sweater, etc.), Parent Telephone Call, Saturday School assigned


**At any offense, if dress code violation cannot be immediately corrected by a change of clothes, and/or wearing over shirt, sweater, etc., student will remain in office until Parent arrives with appropriate change of clothes.




VI.        HONOR CODE                         


What is Academic Dishonesty?


At Calavera Hills Middle School, we value academic integrity and do not permit any forms of dishonesty or deception that unfairly, improperly or illegally enhance a grade on an individual assignment or a course grade. The following is a list of behaviors that constitute academic dishonesty. We are aware, however, that new forms of cheating, plagiarism and other forms of dishonesty may arise and therefore, we expect every student to interpret the requirement of academic honesty and integrity broadly and in good faith. If you have any doubt as to whether a particular act constitutes academic dishonesty, ask a teacher before you do it!


Academic dishonesty includes, but is not limited to:



      Cheating on Exams

  1. Copying from others.
  2. Having or using notes, formulas or other information in a programmable calculator or other electronic device without explicit teachers review and permission.
  3. Having or using a communication device such as a cell phone, pager, PDA or electronic translator to send or obtain unauthorized information.
  4. Taking an exam for another student or permitting someone else to take a test for you.
  5. Asking another to give you improper assistance, including offering money or other benefits.
  6. Asking for or accepting money or any other benefit in return for giving another improper assistance.
  7. Providing or receiving information about all or part of an exam, including answers (Telling someone in a subsequent period what was on the exam or being told this information).
  8. Having or using a “cheat sheet” (a piece of paper with answers, formulas, or notes of any kind) that is not specifically authorized by the teacher.
  9. Altering a graded exam and resubmitting it for a better grade.
  10.  Working together on a take-home exam, unless authorized by the teacher.
  11. Gaining or providing unauthorized access to examination materials.


Note: Simply having possession during an exam of any prohibited or unauthorized information or device, whether or not it is actually used, is an act of academic dishonesty and will be dealt wish as such.

Note: Attempted academic dishonesty, even if unsuccessful, will be treated as academic dishonesty.


Plagiarism in Papers and Assignments
  1. Giving or getting improper assistance on an assignment meant to be individual work. (When in doubt ask.)
  2. Including in any assignment turned in for credit any materials not based on your own research and writing. This includes:
    1. Copying part or all of another person’s paper and submitting it as your own for an assignment.
    2. Using the services of another student.
    3. Copying part or all of another person’s paper and submitting it as your own.
  3. Acting as a provider of paper(s) for a student or students.
  4. Submitting substantial proportions of the same academic work for credit in more than one course without consulting both teachers (self plagiarism).
  5. Failing to use quotation marks where appropriate.
  6. Failing to properly acknowledge paraphrased materials via attribution, footnotes, endnotes and/or a bibliography.
  7. Making up data for an experiment (“fudging data”).
  8. Citing nonexistent sources (articles, books, etc.).


Other forms of Academic Dishonesty

  1. Misrepresenting your academic accomplishments, such as tampering with computer records.
  2. Deceiving a teacher or making up a false reason or excuse to get special consideration on an exam or an extension for an exam or paper.
  3. Failing to promptly stop work on an exam when the time allocated has elapsed.
  4. Copying part of or all of another person’s homework and submitting it as your own.
  5. Forging a signature.
  6. Hoarding or damaging library materials.




The consequences for cheating are as follows:


First Occurrence

  • Teacher/Student conference
  • Parent contacted by teacher
  • Teacher assigned detention
  • Grade to be determined by teacher
  • Letter of apology with parent signature
  • Notification to Assistant Principal

Second Occurrence

  • Referral to Assistant Principal
  • Parent contact
  • Saturday School
  • Referral to counselor

Third Occurrence

  • Referral to Assistant Principal
  • Administrative/parent/student conference
  • School suspension for disruption or defiance

VII.       Consequences

Consequences result when rules are broken. Documentation will be placed in the student’s discipline folder when rule violations take place. Ultimately, we want students to learn to make appropriate choices, which will result in better behavior. The severity of the offense will match the consequence. Consequences include the following, but not necessarily in this order:

*Field-trips and extra-curricular activities are a privilege and may be denied as a result of a School Suspension.


VIII.      Rewards and Recognition

“Catch a student being good” means positive behavior displayed by a student and witnessed by an adult may be recognized with a Coyote Compliment, and entered in a monthly drawing for prizes. They also permit students to move to the front of the brunch and lunch lines. Other recognition includes:

       Honor Roll – published at the end of the first semester for students earning 3.5 GPA or higher, and having no “N”s or “U”s in Citizenship.

       Citizenship Honor Roll – published each grading period for students receiving an “Outstanding” (O) on the progress report from every teacher.

       Citizenship Certificate – presented at the end of the school year to students who have been on the Citizenship Honor Roll on the first through the fifth grading periods.

       Character Trait Awards – recognized at a monthly Coyote Community (School-Wide Assembly), students receiving these awards were nominated by their teachers for exhibiting that month’s Character Trait.

       Positive phone calls home.


IX.        Serious Clause ViolationsSuspension or expulsion may result from any of the following acts:


(a) (1)    Caused, attempted to cause, or threatened to cause physical injury to another person; or

(a) (2)    willfully used force or violence upon the person of another, except in self-defense. [Battery]

(b)        Possessed, sold, or otherwise furnished any firearm, knife, explosive, or other dangerous object.

(c)        Unlawfully possessed, used, sold, or otherwise furnished, or been under the influence of any controlled substance, alcoholic beverage, or intoxicant of any kind, including the prescription drug Soma.

(d)        Unlawfully offered, arranged, or negotiated to sell any controlled substance, alcoholic beverage, or intoxicant of any kind, including Soma, and then either sold, delivered, or otherwise furnished to any person another liquid, substance, or material and represented the liquid, substance, or material as a controlled substance, alcoholic beverage, or intoxicant. 

(e)        Committed or attempted to commit robbery or extortion.

(f)         Caused or attempted to cause damage to school property or private property, including electronic files or databases.

(g)        Stole or attempted to steal school property or private property, including electronic files or databases.

(h)        Possessed or used tobacco, or any products containing tobacco or nicotine products, including, but not limited to, cigarettes, cigars, miniature cigars, clove cigarettes, smokeless tobacco, snuff, chew packets, and betel.

(i)         Committed an obscene act or engaged in habitual profanity or vulgarity.

(j)         Unlawfully possessed or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia, as defined in Section 11014.5 of the Health and Safety Code.

(k)        Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, administrators, school officials, or other school personnel engaged in the performance of their duties.

(l)         Knowingly received stolen school property or private property.

(m)       Possessed an imitation firearm. As used in this section, “imitation firearm” means a replica of a firearm as substantially similar in physical properties to an existing firearm as to lead a reasonable person to conclude that the replica is a firearm.

(n)        Committed or attempted to commit a sexual assault as defined in Section 261, 266c, 286, 288, 288a, or 289 of the Penal Code or committed a sexual battery as defined in Section 243.4 of the Penal Code.

(o)        Harassed, threatened, or intimidated a pupil who is a complaining witness or witness in a school disciplinary proceeding for the purpose of either preventing that pupil from being a witness or retaliating against that pupil for being a witness, or both.

(p)        Aided or abetted the infliction, or attempted infliction, of physical injury to another person; may be suspended but not expelled.

(q)        Engaged in, or attempted to engage in hazing as defined in §32050.

(r )        Engaged in an act of bullying. For purposes of this subdivision refer to Education Code Section 48900-48927



            Committed sexual harassment as defined in §212.5.


            Caused, attempted to cause, threatened to cause, or participated in an act of hate violence, as defined in subdivision (e) of §233.


            Engaged in harassment, threats, or intimidation.


            Made terrorist threats against school officials or school property, or both.

EDUCATION CODE §48915(a) (5)

            Committed assault or battery (as defined in PC 240 & 242) upon any school employee.


TO THE PARENT/GUARDIAN:  Suspensions are issued in compliance with the Education Code of the State of California, Sections 48900, 48910, and 48911. The reason for a suspension will be explained to the pupil, and he/she will have an opportunity to explain his/her version of the incident. Pursuant to Section 48911 (f), the parent/guardian is required to respond without delay to a school official’s request for a conference regarding a pupil’s suspension. The pupil’s parent/guardian has a right to have access to the pupil records as provided by Section 49069.




Expulsion means removal of a pupil from the immediate supervision and control or the general supervision of certificated school personnel and referral of the pupil to an appropriate alternative educational placement.


The Principal or Superintendent is required under state law to immediately suspend and recommend expulsion of pupils that have committed any of the following acts:

  • Brandishing a knife at another person
  • Possessing, selling, or otherwise furnishing a firearm
  • Selling a controlled substance
  • Committing or attempting to commit a sexual assault or sexual battery


The Principal or Superintendent is required under state law to recommend expulsion of pupils that have committed any of the following acts unless the principal or Superintendent finds that expulsion is inappropriate, due to the particular circumstances:

  • Causing serious physical injury to another person, except in self-defense.
  • Possession of any knife, explosive, or other dangerous object of no reasonable use to the pupil.
  • Unlawful possession of any controlled substance.
  • Robbery or extortion.
  • Assault or battery upon any school employee.
